New Republica Constitution
Article 1 - Government

A. The main government body shall be the Republican Council. The Republican Council shall be made up of five members. All laws passed by this body shall only be IC. Anything passed that can be construed as OOC, shall immediately be made null and void.
B. OOC items are to be handled by the Founder of WA Delegate, presumably in conjunction
C. The council holds jurisdiction over the following items: The outcomes of RP wars (if the outcome of a war is unclear), what is the technology cap for a war, the creation of a map, the distribution of land on said map, recruitment for the region.
D. All meetings and votes of the council must be held publicly on the RMB for all nations to see, this is to make sure the council does not become corrupt.

A2. Each council member will have a term of one month, this is to keep membership on the council fresh, and to create activity for NR.
B2. Council members shall be elected by direct election, via the regional poll system, the five nations that get the most votes shall win membership on the council. This is to be done before the end of the present Republican Council’s term. In order to be able to vote, a CItizen of New Republica must be in the region at least a week.
C2. Of the five members elected each election, one shall be chosen by the other members to become the Head Counselor through a vote of the five. The Head Counselor has the responsibility of bringing the council to order, bringing items to vote, and be the public face of the council. The Head Counselor only has the power to vote when an item being voted upon brings about a draw by the other counselors.

A3. Any change to this document must be voted upon via plebiscite of the people of New Republica.
B3. Once a plebiscite has been approved by the people of NR, the Republican Council must pass the item. The minimum required votes from the Republican Council to pass an amendment is the same as to pass a regular item, at least three votes.

Article 2 - The Justice Court

-On the Principles-

The judiciary is composed of two Justices and the Chief Justice, they will compose the Supreme Court of New Republica.
These supreme judges are the guarantors of regional laws, and it is a right and duty of any nation of New Republica to seek legal advice or open vote on the legitimacy of the choices of individual or of the Council, in this way the Supreme Court, has the right and the duty to point out the evident irregularities to the Council, to the WAD and to Founder, which the latter two will take punitive action.
All members are entitled to the vote, the Chief Justice can abstain and participate only in case of tie.

-On the Composition-

The judges are elected only for their office and only for a period not exceeding three months.
The application may be submitted up to 3 times.
The office is not stackable to other part of the Regional Government.
The candidate must have citizenship of the region for at least two weeks.
The candidate must be a member of the WA.
The candidate must not have been sentenced in the last four weeks.
The most voted candidate becomes Chief Justice.
For every twenty new members, starting with the ratification of this Constitution, will be added one seat.

-On the Impeachment-

Each charge of this region is subject to the laws written and approved.
So, the members who are suspected of having worked against the interests of the regional government can be put in to impeachment according to these steps:

- Popular request on the RMB (or poll)
- ¾ majority vote of the Council
- Request by WAD and / or Founder

The Supreme Court will act only if it will be followed all the steps listed above, but if the disciplinary action will cover the second or the third party will not be asked their votes or authorizations.
The Supreme Court after having listened and recorded the testimonies and defenses emits a verdict, in a timely way, of guilt or innocence, in case of conviction the accused loses its privileges and its public offices.
Any verdict of the Supreme Court is to be considered, like the votes of the Council, an expression of an IC government therefore indicative, not imperative.

To preserve the integrity of this office each judge is subject to the judgment of the citizens, but not of the Council, a Judge can be put in to impeachment for failure or betrayal only from WAD.
As a necessary consequence of the judge resigns and the task is taken from the fourth interim judge the most votes in the last election (next in line).

Commission News
    Commissioners Barrington and Pickles, Defence & Peacekeeping and Internal Affairs respectively, were somewhat vocal on the issues surrounding the conflict in the Western Sahara. Following Inquista’s occupation of the Marrakechian zone of the area, the Commission took a firm view against what they saw as an illegal invasion and a breach of European law. Inquista and its supporters countered, claiming the Commissioners did not understand what was going on in the area, and that they should stay out of the issue. Commissioners Barrington and Pickles went further, saying that the Inquistan forces must withdraw, unless they want to risk conflict with the Commissioners home countries of Inimicus and Davishire. This caused considerable controversy, as Barrington and Pickles were seen to be representing their home nations’ governments, rather than the people of Europe as they were elected to do. Despite several calls from the Commission for representation in the subsequent negotiations in Red Croatia and the United Republic of Great Britain, these were ignored.

    A motion for the impeachment of Economics Commissioner Xristos Kalabouris, of Perseus Island, is underway. It is argued that the Commissioner has failed to do his duty and as such has endangered the economies of the region. Little has been heard from Mr. Kalabouris since his election, and it is likely a new, special election will be held for the position of Economics Commissioner in the coming weeks.
European Court of Justice News
    There is no news from the European Court of Justice this month.
Council News
    The Ocean Protection Act, presented by Os Corelia’s Councillor Jelesniak, was passed by the European Council. In stark contrast to the result of the previous Council vote on the bill, this time Councillors overwhelmingly supported the bill, with eight votes for and only one against and no abstentions. Consequently, industrial sewage across the EU must be treated before it is released into the ocean, and single-hulled oil tankers are banned completely, amongst other things.

    Councillor Beatrice Smith of Icholasen proposed The Rights of LGBTQIA People in the EU Act. The bill mandated that same-sex marriages must be legal across the European Union. It also called for sex-changing drugs to be made available to all transgendered people, should they choose to use them. The bill also included an attempt to combat homophobic bullying in schools throughout the region, such as compulsory education on different sexualities. Many objected to the bill, such as Angleter’s new Councillor Montfort, who maintained that ”… Europolis-imposed same-sex marriage is a bridge too far.” The Duxburian Union’s Acwellan Devoy also expressed his disapproval of the act. He pointed out that the Duxburian Union does not have any concept of sexual orientation, believing it is something you do, not something you are. Speaker Devoy concluded with ”You want to overwrite two thousand years of de facto and de jure equality in favor of a system that tells us that we are not equal because of what we look like or what we like to do? That doesn't make a shred of sense and is outright uncivilized." The bill was defeated, with seven votes against and only one in favour. There were no abstentions.

    Councillor Eloise Murray of Miraco proposed a bill which would standardise healthcare accreditation standards throughout the EU. According to the bill, it would ”… enhance cooperation throughout the European Union as well as ensuring geographical mobility for EU residents working in the healthcare industry.” There were concerns that the bill removed too much power from the European Council and that a section was unconstitutional. However, an amended form of the bill was passed, with five votes for, two votes against and two abstentions.

    The Alliance of Liberals and Democrats for a Green Europe have unveiled their new deputy leader. According to an ALDGE press release, Councillor Pamela Winchell of Icholasen will take up the position, and would also be the leader of the ALDGE Bloc in the European Council. ALDGE Party Chair Ms Karolinasz Jaedala of Os Corelia is said to have appointed Winchell as, aside from Os Corelia, Icholasen is the only other member state with a councillor that sits with the ALDGE.
Other News
    As referenced earlier, Inquistan forces moved into a portion of the Western Sahara that was occupied by Marrakechian forces.  This ended a three year understanding, where the Sahara region was divided into two sections, one administered by the Kingdom of Marrakechia, the other by Inquista. This was  a result of the conflict of 2011, where Marrakechia sought to bring the entirety of the Western Sahara under their control, following its de facto independence under the Polisario Front. Inquista assisted the Marrakechian forces, but did not withdraw its troops from a section of the region, leading to the situation that lasted until a few weeks ago. Inquista claims that the people of the Sahara had suffered under Marrakechian rule, and that only the unification and full independence of their country could allow for them to become prosperous and happy once more. After the initial occupation of the Marrakechian Sahara, The Sahrawi Union was declared, sponsored by Inquista and Red Croatia, who formed the Committee for Western Sahara Autonomy. The new nation encompasses the whole of the Western Sahara, but has not been recognised by all members of the EU. Currently, only members of the WSA Committee have recognised the new state, namely Inquista, Red Croatia, Rimroth, the Althanian Dominion and Icholasen.

    The crisis in the Sahara created tensions within the EU not seen for several years. Many member states rejected the Inquistan occupation as a breach of Marrakechia’s territorial integrity. Amongst them was The Twelve Commonwealths of Halsberg, who sent airborne troops into the Sahara’s major cities to secure members of the Marrakechian Royal Family who were residing there following a request from King Charly himself. Negotiations began in Zadar, Red Croatia, amid threats of force from Davishire and Groot Belgie. The conference in Zadar achieved little, and as such President Cynthia Johnson of the United Republic of Great Britain hosted a new meeting of the key players in the crisis, in an attempt to avoid any bloodshed. Representatives of Inquista, Marrakechia, Red Croatia, Halsberg and the United Republic met in London to discuss the crisis and come up with a diplomatic solution. Despite some raised voices and sharp words, they succeeded, and an official agreement was reached. A referendum will be held in the Western Sahara, overseen by observes from the United Republic, to determine whether the people wish to become independent under The Sahrawi Union, or return to the Kingdom of Marraekchia’s administration. The referendum will be carried out in the next few months. Inquistan, Rimrothian and Halsbergian troops remain in the region.

    The last month also saw one of the most eventful coronations in the EU’s history. Following the King of Icholasen’s apparent death, his daughter Anastasia was to become Queen. The ceremony began as one would expect, with many foreign dignitaries present, such as the Inquistan Archbishop Paul Craticus, Red Croatia’s Queen Aleksandra and Halsberg’s High President Michael Solomon. However, the coronation became engulfed in drama worthy of a television hit, as it was revealed that the King was not in fact dead. He named his other daughter, Anastasia’s sister, as his would-be murderer. The Duchess of Saint Pierre confessed to the crime, saying she would have gone on to kill Anastasia and claim the throne for herself. The Duchess evaded capture, however, escaping with an accomplice masquerading as a security guard in a helicopter that was waiting nearby. The King, realising how hurt Anastasia was and how much she was looking forward to becoming Queen, abdicated to allow her to assume the throne.

    To celebrate the coronation of the new Queen Anastasia of Icholasen, the foreign dignitaries were invited to dinner at the royal palace. There are rumours that many of the region’s most eminent leaders had a little too much to drink. According to one member of the royal staff, who remains anonymous, he had never seen such a display of debauchery. The source went on to say that there appeared to be a particular hostility towards Emperor Jules of Groot Belgie from the Inquistan Archbishop. It is said that, after flicking peas and throwing various items of silverware at the Emperor, he proceeded to throw a large cream pie in the Emperor’s face. The Anitax Aureliana of the Althanian Dominion was also referenced by the source. Apparently, after getting somewhat intoxicated in a bar before the dinner began, she arrived at the banquet and got even more intoxicated. She is also rumoured to have been extremely jealous of the Queen Anastasia, who was getting somewhat flirty with Halsberg’s Edmund XI, the Duke of Roeburg. According to the source, Aureliana was like a desperate schoolgirl who wanted a boyfriend.

Commission News
  • The election season for Commission XVI began in earnest in late March. The seven candidates represented an increase from last time, where only five were nominated and as such all were guaranteed a seat.  Turnout was somewhat low, at only 11.4%, with 14 out of 123 member states casting their vote. In the vote to determine Premier, Nouvelle Picardie’s Chasca Nayra won 53.8% of the vote and was therefore elected as the EU’s senior commissioner.
  • A new enquiry into the attitudes of member states towards matters of justice is planned by the Internal Affairs Commissioner.
  • The Internal Affairs Commissioner has also led a discussion on the future of the European Commission itself. There was general consensus that the executive branch of the European Government is important, but several ideas for reform were offered.
  • Commissioner for Defence and Peacekeeping, Sir Augustus Barrington of Inimicus has been touring Europe. His first stop, to Groot Belgie, is ongoing.
European Court of Justice News
  • Elections were held for the ECoJ. Only five candidates put themselves forward to be elected justices, and as such all were guaranteed seats in the Court, regardless of the votes.
  • The position of Chief Justice, however, was still up for grabs. Two candidates, Steven Doberman and David Lee, were fighting for the position. In the end, Doberman claimed victory, securing just over three quarters of the vote.
Council News
  • Davishire’s Councillor, Nicola Heaven MP, presented a bill to the Council which would place several restrictions on the use of capital punishment in member states. The bill would have seen restrictions on what could constitute a capital crime and mandated that prisoners on death row be allowed numerous rights, such as legal advice and religious support. The bill was defeated, with only one vote in favour and two against, not forgetting two abstentions.
  • Cllr. Heaven again brought the issue to the Council chamber, with her more direct Capital Punishment Abolition Bill, which sought to ban the use of the death penalty outright throughout the Union. The bill roused many councillors, who defended their views admirably. Indeed, the subject of the death penalty saw one of the most heated exchanges since the days of Marshall and Zapatero, with the councillor from Groot Belgie going so far as to say his government would refuse to implement the bill should it pass. Tension was created throughout the region thanks to this sentiment, with many member states growing increasing anxious over Groot Belgie’s bellicose opposition to the legislation. The Groot Belgie Times reported that the government would not pass the bill under any circumstances while also reporting an increase in military recruitment as a result. The Commissioner for Internal Affairs felt it right to intervene, asking the Groot Belgie councillor to reconsider his vehement opposition in the interests of maintaining regional peace and stability. Fortunately for Groot Belgie, the bill did not pass, with three in favour and four against, with one abstention.
  • A bill to introduce a European Central Bank was also proposed. Sir George Barringer, the Duke of Weselton, wished to see a central bank independent of both council and commission. However, many councillors expressed concerns that such an institution would be unaccountable and would exercise too much control over non-eurozone member states. The bill was totally defeated, with not even one vote in favour.
  • The Ocean Protection Act, last seen almost a year ago when it was defeated in the Council, has made a return. Os Corelia’s Count Jelesniak has reintroduced the bill which aims to control the amount of pollution reaching the region’s oceans. If passed, the OPA would be the first environmental legislation the region has ever seen. The debate remains ongoing.
  • Councillor John Walters has demanded a reshuffle of the committee dedicated to rewriting the Universal Declaration of Human Rights. He claims that the lack of active members on the committee has caused work on the document to stall, and has similar sentiments over the committee tasked with redrafting the constitution. In response, Count Jelesniak, the leader of the UDoHR committee, has announced that the group will be reformed completely with councillors welcome to apply to join.
  • Councillor Anatoly Keith stepped down from his post as Angleter’s European Councillor. He had been in the role for five years, making him one of the longest serving councillors of all time. Regarded as one of the EU’s most senior statesmen, Anatoly’s achievements include serving as the first Speaker of the European Council and presenting the long-awaited Committee Reform Act. He is replaced by Peter Montfort, former Commissioner of two and a half terms.
  • Also stepping down is long-time Union of European Conservatives leader Christopher Brown of Halsberg. The inaugural party president said: “I feel it is time for the party to benefit from a new vision, to take a new direction.” Leader for two and a half years, Brown has handed the party presidency to Inimican Wilfred Cocx. The former Prime Minister of Inimicus was elected unopposed and now heads the European Union’s largest party.
  • The ALDGE have also lost their party leader. Party President Arcturus relinquished command, and a leadership election was called. Corelian Karolinasz Jaedala is the sole candidate, and looks set to take over from Arcturus. According to eminent stateswoman Maleeka Liszckoszi, Jaedala has been “a strong European commissioner for defence and peacekeeping with a strong record in the role in line with our vision.”
Other News
  • Rimroth’s governing party, the National Rimrothian Front, have kept control of parliament. PM Richard Watson remains in power.
  • Marrakechia’s rather eclectic music festival Mawazine got underway, with headliner Indila being joined by the Imperial Symphony Orchestra of Inimicus and the Orchestre des Forces Royales Air du Marrakechia.
  • Northern Caesarea has elected a new government. Prime Minister Izan Roch has signed a pact with the Social Democrats, Greens and Gavachois Nationalists where they will support cabinet policies. The country’s European councillor has been replaced with Gabriela Espinosa, who sits with the ECL.
  • The Corelian controversy over the island of Westfallon continued throughout March and April. During the election campaign, many Corelians demanded that candidates pledge to recognise the existence of Westfallon and as such rectify the cartographical error which caused so much offence to the islanders.
  • World Youth Day 2014 is underway in New Birmingham, Angleter. The new Pope Aloysius was present during the festivities, which saw bishops giving talks to young people on the importance of today’s youth in society.
  • Rumours that Cardinal Daneels of Groot Belgie is guilty of murder came back to haunt him, as the Pope ordered an enquiry into the incident. A crack investigation team consisting of Angleter’s Cardinal Unctious and Sister Agnes Gerardi are on the ground in Groot Belgie. Their enquiries are ongoing.
  • Rumours that the next EuroVoice contest is imminent have been circulating throughout Europe. Not seen since January, the EuroVoice contest has delighted the region no less than 20 times, with the 21st eagerly anticipated. Despite claims that the contest could begin as early as next week, neither the EUBC nor the host broadcaster would comment.

Referendums / Should we amend the constitution.

In the betterment of the region the constitution states that for a constitutional amendment to pass it only needs a approval from the judicial branch or the senate. This one word "or" has created a lot of trouble for the region.

Whereas, the statement "As such, any amendment requires a Majority Vote in the Senate or Approval from the Judiciary" the part where it says or shall be removed and replaced with the word "and".

This Herebys removes the word or and replaces it with and in the section with the constitutional amendments.
