New Republica Constitution
Article 1 - Government
A. The main government body shall be the Republican Council. The Republican Council shall be made up of five members. All laws passed by this body shall only be IC. Anything passed that can be construed as OOC, shall immediately be made null and void.
B. OOC items are to be handled by the Founder of WA Delegate, presumably in conjunction
C. The council holds jurisdiction over the following items: The outcomes of RP wars (if the outcome of a war is unclear), what is the technology cap for a war, the creation of a map, the distribution of land on said map, recruitment for the region.
D. All meetings and votes of the council must be held publicly on the RMB for all nations to see, this is to make sure the council does not become corrupt.
A2. Each council member will have a term of one month, this is to keep membership on the council fresh, and to create activity for NR.
B2. Council members shall be elected by direct election, via the regional poll system, the five nations that get the most votes shall win membership on the council. This is to be done before the end of the present Republican Council’s term. In order to be able to vote, a CItizen of New Republica must be in the region at least a week.
C2. Of the five members elected each election, one shall be chosen by the other members to become the Head Counselor through a vote of the five. The Head Counselor has the responsibility of bringing the council to order, bringing items to vote, and be the public face of the council. The Head Counselor only has the power to vote when an item being voted upon brings about a draw by the other counselors.
A3. Any change to this document must be voted upon via plebiscite of the people of New Republica.
B3. Once a plebiscite has been approved by the people of NR, the Republican Council must pass the item. The minimum required votes from the Republican Council to pass an amendment is the same as to pass a regular item, at least three votes.
Article 2 - The Justice Court
-On the Principles-
The judiciary is composed of two Justices and the Chief Justice, they will compose the Supreme Court of New Republica.
These supreme judges are the guarantors of regional laws, and it is a right and duty of any nation of New Republica to seek legal advice or open vote on the legitimacy of the choices of individual or of the Council, in this way the Supreme Court, has the right and the duty to point out the evident irregularities to the Council, to the WAD and to Founder, which the latter two will take punitive action.
All members are entitled to the vote, the Chief Justice can abstain and participate only in case of tie.
-On the Composition-
The judges are elected only for their office and only for a period not exceeding three months.
The application may be submitted up to 3 times.
The office is not stackable to other part of the Regional Government.
The candidate must have citizenship of the region for at least two weeks.
The candidate must be a member of the WA.
The candidate must not have been sentenced in the last four weeks.
The most voted candidate becomes Chief Justice.
For every twenty new members, starting with the ratification of this Constitution, will be added one seat.
-On the Impeachment-
Each charge of this region is subject to the laws written and approved.
So, the members who are suspected of having worked against the interests of the regional government can be put in to impeachment according to these steps:
- Popular request on the RMB (or poll)
- ¾ majority vote of the Council
- Request by WAD and / or Founder
The Supreme Court will act only if it will be followed all the steps listed above, but if the disciplinary action will cover the second or the third party will not be asked their votes or authorizations.
The Supreme Court after having listened and recorded the testimonies and defenses emits a verdict, in a timely way, of guilt or innocence, in case of conviction the accused loses its privileges and its public offices.
Any verdict of the Supreme Court is to be considered, like the votes of the Council, an expression of an IC government therefore indicative, not imperative.
To preserve the integrity of this office each judge is subject to the judgment of the citizens, but not of the Council, a Judge can be put in to impeachment for failure or betrayal only from WAD.
As a necessary consequence of the judge resigns and the task is taken from the fourth interim judge the most votes in the last election (next in line).
